This is our situation today: Thor's Hammer is the ancient ancestor of the modern Judicial Gavel, presiding throughout the Western world over the convening and dajourning of legal and governmental assemblages. The Gavel opens Legislative sessions and directs proceedings; it commences court proceedings, maintains order, seals verdicts and authorizes sentencing in the cause of justice. The 'passing of the Gavel' in fact has come to mean the transfer of power to a new holder of authority in any official meeting, legal proceeding, or political assembly. THE GRAND JURY Although Legislative and Judicial functions, directed by the will of the people, are of great importance in maintaining Just Government, the Executive function, in the hands of the people, is the most vital and powerful guarantor of Justice. This Executive Power, which can over-ride and over-rule all actions of elected and appointed government office holders, is found in the institution known as the Grand Jury: an assembly of civilian persons empowered specifically to investigate citizens' claims of wrongdoing by said office holders --to hear complaints, call witnesses, subpoena documents, gather and review evidence, and to issue Indictments against the government office-holding offenders. Thus the Grand Jury comprises the answer to the age-old question regarding government: "Who guards the guardians?" Political, Administrative, and Law Enforcement offices are created to secure and protect the public health and safety from domestic crime and foreign invasion, but how are the holders of these offices themselves prevented from using their granted authority to cheat, rob, and otherwise abuse (often in collusion with domestic criminals and foreign aggressors) the very People to whom they are enlisted to serve? Certainly higher rankings of 'guardians' cannot be expected to be any more honest or free of corruption than those already imposed on the Public: only the Sovereign power of the People themselves can be entrusted with such responsibility, in the form of a non-professional and financially disinterested deliberative body of well-educated citizens --a Grand Jury. This is known as the Doctrine of Separation of Powers in a Constitutional Republic. With honorable office holders, the system works very well, and the People believe they are under Just Government, or Government de Jure. But suppose some officials are not honorable, and actively seek to corrupt the processes of government to their own devious ends? Then Who Governs the Government? Most citizens will declare "The Voters" --in coming elections of new officials. And this is the defect in our present conduct of Law and Politics: only one branch of power is exercised by the People -the Legislative, expressed as votes in popular elections. But the people neglect their right to two other votes, respectively in the Executive and Judicial functions. These are the two 'Juries': the Grand and the Petit (or small). The latter is quite familiar to most people as the Trial Jury, on which citizens sit to hear criminal and civil cases in the courts. But few citizens know their full duty and power as jurors: instead they believe "the law is the law" and follow the Judge's instructions in rendering a verdict in conformance with a literal reading of the law, allowing no interpretation of its language, consideration of its application, or, most important, judgement of its constitutionality. Thus, many convictions are obtained through defective trial juries. In other words, bad law, and bad application of law needs to be recognized and called out by educated citizen jurors right there in the jury room, with votes of "not guilty" in unjust criminal trials. But this type of jury action seldom occurs, even though bad law practice abounds. Only an enlightened jury is competent to sit at a trial, a jury whose members know they have the Sovereign authority to vote out bad law in any criminal trial with "not guilty" verdicts -to nullify its application in any particular case. About century ago, when citizens were more savvy, this power was used to negate all the bad laws passed during Prohibition, laws which not only violated civil rights, but which only made the social situation worse. Awareness of this power by jurors is absolutely essential to Just Government. In that jury room, each juror is a Sovereign Power, whose vote, or decision in the case, cannot be over-ruled by anyone, not the Judge, nor the prosecutor, nor the Governor, nor the President --no one can over-rule that juror. The Grand Jury is much less understood by the general public: Jurors here are impaneled to exercise the citizen's Executive power in Governance. Like the ballot vote in popular elections, and the small jury vote in criminal trials, the Grand Jury vote is also a Sovereign Power of the Citizen, now exercised against a corrupt and criminal Administration of government when its institutions have failed in their constitutional duties and limitations. The principal function of the Grand Jury, then, is for Citizens to lay hold of the Executive function of government itself, and Indict its office holders for any wrongdoing which the Grand Jury may discover by Investigation. This is perhaps the most vital civic function a citizen can exercise: politicians, bureaucrats, government officers, employees and contractors, -even Judges and Prosecutors-, may be investigated, subpoenaed, interrogated, cross-examined, and charged with crimes themselves and sent to face trial in an appropriately designated Court. When duly convicted, the corrupt 'Rulers' go to jail. This all-important empowerment of citizens essentially reverses the 'normal' relation between Government and the People: Quis custodiet Custodes? The People Govern the Government! They accomplish this through informed action in all three branches of their Sovereign power.
